This week we will look at the deliberate destruction of our constitutional republic during the 150+ years of ruling class betrayal by those we elect to represent us and their appointed minions in the Administrative State.
Compound that betrayal with the appointment of activist judges and a court system meant to function under Common Law, but operating under Admiralty and Corporate Law and you have a recipe for constitutional crisis such as we face today.
The Founder's promise of limited, constitutional government understood the critical differences between natural (God given) law and the administrative (Justinian) law produced by monarchs, lawyers and bureaucrats. Natural Law was anchored in personal responsibility and accountability for bad decisions, while Administrative Law focused on process and contracts between parties. Natural Law requires an understanding of right and wrong whereas Administrative Law only requires conformity with policy and who can afford to hire the best lawyer, irrespective of guilt or innocence.
The Founders knew that a legal system based on God given or unalienable rights would be the only way that justice could be maintained in a clear and consistent way, guaranteeing equal justice for all based on biblical absolutes, not social or economic status. This simple but revolutionary concept is at the heart of our Declaration of Independence and later contained in the Articles of Confederation, the U.S. Constitution and original Bill of Rights.
Will a return to the Common Law legal framework of our founders and a clearer understanding of the perverted Justinian (contract law) system that is currently controlling the vast majority of our courts break us free from our Robber Baron legacy of opportunism, favoritism, and power elitism?
Can we elect leaders of wisdom and principle willing to return this experiment in liberty to the average Americans that want nothing more than freedom and the opportunity to make a better life for their families?
That is entirely up to us and the passion of our commitment to return to responsible leadership. Our Constitution can save us if we are only willing to understand and re-engage it to save our republic.
