It seems like most of my podcasts have focused on extremely dark subjects lately: wars, political/civil unrest, pandemics and assassinations of political leaders like JFK. Sometimes I need to step back and realize that I might be overdosing in reality and could use a bit more common sense discussion with my favorite Common Lawyer, Brent Allan Winters, to take the sharp edges off my podcast. The Lord has blessed me with a sense of curiosity that makes me want to connect dots…………both good and bad, but he also blessed me with the desire to meet and befriend uniquely different personalities in ways that have brought genuine pleasure and purpose to my life. Over a very colorful and blessed lifetime, I have interviewed many thousands of people from every walk of life, and of nearly every political persuasion. Although some have such a lack of common sense about human nature that it actually becomes annoying, I have found that most normal people regardless their political inclinations want more or less the same thing; a happy/meaningful life for themselves and their families. So, that being the case, how in the world did we allow ourselves to be swallowed by the morass we find ourselves in today? Answer; because most folks would rather be led than lead, and are too intellectually lazy or preoccupied to expend the time and effort needed to select good leaders. This is the premise of Judge Robert H. Bork's book Slouching Toward Gomorrah.
Our Founders clearly understood the difference between Common Law and Justinian (Administrative Law) and chose Common Law as the foundation for our system of government for good reason. It is anchored with God's natural law under the Ten Commandments and allows the maximum amount of individual freedom tethered to accountability and personal responsibility. This podcast will discuss the systematic dismantling of our republic during two centuries of political malfeasance by those we elected to represent us and their paid minions within the ever expanding Administrative State.
Moreover; compounding Legislative malfeasance with the appointment of activist judges under a court system originally meant to be administered under a Common Law system, but increasingly operating under Admiralty and Corporate Law, created the constitutional crisis we face today. The Founder's system of limited, constitutional self government stressed the fundamental differences between natural law and the convoluted form of administrative law produced by monarchs, lawyers and bureaucrats. Natural Law can only function under a moral system of personal responsibility and accountability for bad decisions, while Administrative Law stresses procedure and contracts between parties. Natural Law requires common sense and an understanding the differences between right and wrong while Administrative Law only requires conformity with bureaucratic policy and agency rulemaking irrespective of guilt or innocence for an actual crime.
The Founders knew that a legal system based on God given (unalienable) rights would be the only way that equal justice for all could be maintained in a clear and consistent way, based on biblical absolutes, not ever changing social or political fads such as social justice and DEI indoctrination. This simple but revolutionary concept is at the heart of our Declaration of Independence and later contained in the Articles of Confederation, the U.S. Constitution and our Bill of Rights. Thus, we must restore the Common Law legal framework of our founders and abandon the perverted Justinian (contract law) system that is currently controlling the vast majority of our courts. This, and only this, will break us free from progressive socialism, faddish opportunism, favoritism, redistribution of wealth, and Judicial lawfare. We must select leaders of wisdom and principle willing to return this experiment in liberty to the average Americans that want nothing more than opportunity, freedom and the chance to make a better life for their families? That is entirely up to us and the passion of our commitment to return to responsible leadership. Our Constitution can save us only if we are willing to re-employ it and elect Statesmen rather than political opportunists to represent us.
